This Anatomy displays the two most important constitutional documents in Canada's history: Constitution Act, 1867 (UK), 30 & 31 Vict, c 3, reprinted in RSC 1985, App II, No 5. Constitution Act, 1982, being Schedule B to the Canada Act 1982 (UK), c 11. "The Living Tree" refers to the doctrine of the same name established in the Privy Council case of Edwards v Canada (AG), 1929 UKPC 86, per Vicount Sankey. This doctrine suggests that courts should not interpret Canada's constitutional framework from an originalist perspective, but should rather characterize these pieces of supreme legislation as documents which grow with the times and should be interpreted liberally and in accordance with the current sentiments of Canadians.
